Terms of Service

By using mystackfinder.com, a Stack Finder kiosk, or the Stack Finder experience on your own device, you agree to these terms. If you do not agree, please do not use them.

These terms are between you and Cigar Stacks LLC, a Florida limited liability company.

Retailers licensing Stack Finder sign a separate written agreement covering pricing, tier thresholds, hardware, and term. Where anything on this website conflicts with that signed agreement, the signed agreement governs. Nothing on this site is an offer or a binding quote.

Stack Finder concerns tobacco products and is intended solely for people aged 21 or over. By using it you confirm you meet that age requirement.

Stack Finder does not sell tobacco and does not process payment for it. When a guest sends an order to the counter, a ticket is created on the retailer's own point-of-sale system. The sale, the payment, and the age verification all happen in person, with that retailer's staff, under that retailer's licences and local law.

Retailers are solely responsible for the legality of what they sell, for verifying age at the point of sale, and for complying with the rules that apply to them.

• Plans are billed per location, per month, in advance.
• Every feature is included at every tier. Tiers are set by how many orders the kiosk creates on your register in a month.
• Your specific thresholds are agreed with you before you sign and written into your agreement. You will be notified before a tier changes, and changes are never applied retroactively.
• If Stack Finder does not perform in your shop, you keep every feature at the entry price. The exact terms of that commitment are in your signed agreement.
• The kickoff fee covers your branded wrap, setup, on-site installation, staff training, and your first month.

The iPad, stand and wrap supplied with a subscription are provided as part of the service and remain the property of Cigar Stacks LLC unless your agreement says otherwise. We maintain them for normal use. You are responsible for loss, theft, or damage beyond normal wear, and for returning the equipment if your subscription ends. Specifics are in your signed agreement.

You agree not to:

• Use the service if you are under 21.
• Attempt to access another retailer's data, or any part of the system you have not been granted access to.
• Reverse-engineer, copy, or attempt to extract the recommendation or pairing logic.
• Interfere with the service, probe it for vulnerabilities, or overload it.
• Misrepresent your location to obtain in-premises pricing or ordering.
• Use the service for anything unlawful.

Stack Finder — including the software, the recommendation and pairing engines, the interface, and the name and branding — is owned by Cigar Stacks LLC. A subscription grants you the right to use it for your shop while your agreement is active. It does not transfer ownership of anything.

Your catalogue, your inventory data, and the customer contacts captured at your kiosk remain yours.

Any figures shown on this website that illustrate potential revenue are clearly marked as illustrative and are arithmetic examples, not predictions. Results depend on your shop, your stock, your pricing, your traffic, and your staff.

We do not promise any particular increase in sales, basket size, or customer capture.

Stack Finder connects to services you already use or that we use to operate — point-of-sale platforms, email and messaging tools, and hosting. We are not responsible for outages, changes, or losses caused by those third parties, though we will work with you in good faith when they occur.

We aim to keep Stack Finder running continuously but do not guarantee uninterrupted service. Maintenance, connectivity problems at your premises, and third-party outages can all interrupt it. The kiosk is a supplement to your staff, not a replacement for the ability to sell without it.

Except as expressly stated in a signed agreement, the service is provided “as is” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Cigar Stacks LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data.

Our total liability arising out of or relating to the service is limited to the amounts you paid us in the twelve months before the claim arose.

Retailers agree to indemnify Cigar Stacks LLC against claims arising from their own sales, their compliance obligations, their age verification, and their use of customer data collected through their kiosk.

Either party may end a subscription in line with the signed agreement. We may suspend access for non-payment or for a breach of section 07. On termination, your access ends, equipment is returned, and your data is deleted or returned on request within a reasonable period.

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Disputes will be brought in the state or federal courts located in Broward County, Florida.

We may update these terms. The date at the top will change, and material changes will be communicated to retailers directly. Continued use after a change means you accept the updated terms.
